Power, water, and the Falls

Study capacity before assuming supply

Proximity to hydroelectric generation does not establish an available power allocation, interconnection capacity, or a project's effect on residential rates. Electrical demand and cooling water demand require separate studies.

The 1950 Niagara treaty establishes scenic minimum flows and divides water available for power purposes equally between the countries. The table summarizes Article IV using the treaty's stated Eastern Standard Time (EST), rather than silently converting to daylight time.

Niagara Falls' industrial future begins with land that already has a history. At Love Canal, chemical disposal led to evacuation and a cleanup whose containment and monitoring obligations continue. Nearby Hyde Park, S-Area and the 102nd Street landfill are separate sites with their own records. Their shared industrial setting makes them relevant to redevelopment, but it does not establish that every nearby property has the same contamination or that waste is moving between them.[1] [2] [3] [4]

Beyond those better-known landfills, the regional record includes Necco Park, the former Forest Glen subdivision, Frontier Chemical on Royal Avenue, and the separate Nash Road and Witmer Road disposal sites in Wheatfield. Their cleanup histories explain why a single regional label is insufficient: a former residential subdivision, a waste-processing property and a municipal-industrial landfill require different site records and controls before any future use can be assessed.[19] [20] [21] [22] [23]

Recent investigations show why that history still matters when ground is disturbed. On western Cayuga Island, utility-work soil borings in fall 2025 prompted renewed state investigation of mercury, pesticides and other contaminants along West Rivershore Drive. June 2026 reporting describes soil, vapor, indoor-air and sump-water sampling; September reporting describes an expanded investigation. This is new scrutiny of historical industrial fill, rather than proof of recent dumping across the island.[5] [6]

A separate 2026 investigation concerns a 99th Street residential property near Love Canal, where excavation exposed suspect material. Residents sought relocation and commissioned private testing; DEC said it was committed to investigation and remediation and cautioned against disturbing the material before that work. The findings and the family's concerns warrant attention, but proximity and similar chemicals alone do not establish that the Love Canal containment remedy is leaking into this property.[7]

Radioactive industrial fill adds another part of the story. EPA reports completed removals at the Niagara Falls Boulevard properties, Upper Mountain Road residences, properties adjacent to Holy Trinity Cemetery, and Donovan Head Start's playground and parking area. The broader Niagara and Erie County assessment is still evaluating other locations. In its September 18, 2026 update, DEC reported more than 1,020 properties screened, more than 760 notified that no additional investigation was needed, and 37 referred to EPA for additional assessment. These are dated screening outcomes; a referral is not confirmation of contamination.[8] [9]

In Lewiston, the Niagara Falls Storage Site presents a different cleanup responsibility. USACE's September 2026 update describes substantial excavation progress alongside a localized discovery of additional contaminated material at EU04, to be addressed through a future contract. That excavation is distinct from the engineered waste-containment structure and surrounding vicinity properties. Taken together, the records show both completed cleanup work and remaining obligations, which must be checked property by property.[10]

The environmental record also extends beyond buried waste. DEC's Goodyear record describes a January 2025 consent order requiring controls to reduce ortho-toluidine emissions, while its Cascades record documents persistent-odor enforcement in 2021. At the Allied Waste landfill, EPA announced a proposed $671,000 Clean Air Act penalty and landfill-gas controls in January 2024. These actions concern different facilities, pollutants and legal requirements. DEC specifically distinguishes Goodyear's reporting violations from noncompliant ortho-toluidine emissions; they should not be collapsed into a single claim about neighborhood exposure.[11] [12] [13]

Resident compensation must be read just as carefully. Counsel's history in a later court filing reports a $950,000 settlement in Hickey v. AW Niagara Falls in 2021. The original approval and distribution records are still needed before this review can say how much individual residents actually received. That reported class settlement is separate from the federal landfill penalty. Love Canal likewise has separate financial histories: UB's chronology records a $20 million resident settlement, including a medical trust, while DOJ's $129 million 1995 agreement recovered federal cleanup and relocation costs.[14] [15] [16]

The wider river corridor connects this local history to regional work without making every problem identical. In nearby Erie County, Tonawanda Coke's 2015 civil agreement combined penalties, pollution controls and environmental projects rather than distributing its entire headline amount to residents. Across the border in Welland, the Lyons Creek East project reports that natural recovery of PCB-contaminated sediment has not occurred in some areas and describes evaluation of other management options. Neither record identifies the source of contamination at an unrelated Niagara Falls property.[17] [18]

The production map also changes over time. Greenpac is listed by its operator at 4400 Royal Avenue, separately from the Packard Road mill whose closure Cascades announced in 2025. OxyChem announced the end of its Niagara Falls manufacturing operations in 2021, while Chemours' filings record the end of its Niagara Falls Reactive Metals Solutions production in September 2016. Older sites add another layer: DEC's Buffalo Avenue record traces the former Shredded Wheat and Nabisco biscuit plant. These histories show why a factory name, an old permit and a cleanup record cannot by themselves identify a current operating plant. The map now separates listed manufacturing facilities, documented former operations, historical plant records and manufacturing-linked entries that still need status review; it does not treat industrial inclusion as evidence of pollution.[24] [25] [26] [27] [28]

For redevelopment, the practical question is how to protect residents while comparing viable uses of each site. Cleanup restrictions, present exposure pathways, permanent jobs, utility demand, incentives and public costs belong in the same decision. A manufacturing upgrade, technology facility or mixed-use plan needs current evidence on those terms. This review does not rank those choices: the survey below asks which approach, priority and missing information residents want the city to consider. Future updates will revise this account as sampling results, remedy reviews and original court records become available.
